Terms of Service
These Terms of Service ("Terms") govern the use of services provided by Nestsen.com Ltd ("Nestsen", "we", "our", or "us") to you as a business customer ("you", "your", "Customer").
1. Who We Are
Nestsen.com Ltd is a company incorporated in Scotland with registered office at 18–20 North Street, Glenrothes, Scotland, KY7 5NA. We provide property operations software, including automated maintenance triage and communication tools.
2. Eligibility and Director-Level Agreement
- Services are provided business-to-business (B2B) only.
- Use of our services implies acceptance of these Terms by an authorised company director.
3. Our Services
We provide:
- Automated maintenance triage via WhatsApp, SMS, or other approved channels.
- Reporting and issue management through the nestsen.com platform.
- CMS integration for contracts of 24+ months with 100+ properties.
Optional add-ons including:
- Third-party downstream integrations.
- CMS integration for portfolios below inclusion thresholds.
4. Trial Period
You may request a demo account for free charge for:
- 100 days
this can be converted to a paid subscription at any time.
5. Pricing and Billing
- Standard pricing is £POA per occupied property per month.
- Billed in arrears, based on the maximum number of occupied properties during the month.
- Invoices issued on the 1st of the month, payable within 30 days.
If payment is not received:
- Reminder issued after 15 days.
- Suspension after 30 days.
- Service will be terminated and debts pursued if unresolved.
Volume or Negotiated Discounts
Discounted pricing may be available based on:
- Contract length
- Property volume
- Strategic value
These discounts must be agreed in writing before being applied.
6. Contract Length and Termination
- Rolling monthly agreement.
- 30 days' notice for termination if portfolio is under 1,000 properties.
- 90 days' notice required if portfolio exceeds 1,000 properties.
- We reserve the right to terminate immediately for misuse, abuse, or breach of these Terms.
7. Data and Privacy
- You are responsible for all personal data uploaded or integrated into the platform.
- Nestsen stores, but does not validate or alter, this data.
- You must ensure GDPR compliance for any tenant or user data you process.

8. Support and Availability
- Support hours: 9am–5pm (UK time), Monday to Friday.
- Channels: email and in-platform support.
- Target uptime: 99.9% monthly availability.
- Scheduled maintenance will be announced with 14 days' notice (except for urgent security updates).
- Platform is provided "as is" without guarantees of uninterrupted access.
9. Third-Party Tools
Nestsen integrates or depends on external platforms including:
- WhatsApp (Meta)
- Azure (Microsoft)
- ChatGPT (OpenAI)
- Gemini (Google)
We do not guarantee performance or availability of these tools and accept no liability for their failure or change in terms.
10. Limitation of Liability
Our total liability is limited to 50% of the fees paid in the previous month.
We are not liable for:
- Loss of profits, data, or business.
- Indirect, consequential, or punitive damages.
- Failures caused by third-party platforms or force majeure events.
11. Intellectual Property
All rights to the Nestsen platform, branding, and content remain with Nestsen.com Ltd. You are granted a non-exclusive, non-transferable right to use the platform under these Terms.
12. Governing Law
- These Terms are governed by the laws of Scotland.
- Any disputes shall be resolved in the Scottish courts.

14. Cookies & Local Storage
Nestsen uses browser cookies and local storage to operate the site, keep you signed in, and (with your consent) collect anonymous analytics. The table below lists every cookie and storage item we set, grouped by category.
Essential — always active
These are required for the site to function. You cannot opt out of essential cookies while using Nestsen.

Functional — always active
These localStorage and sessionStorage entries save in-browser state to make the app work smoothly. They are never sent to third parties and are not cookies in the technical sense (no expiry date is set server-side).

Analytics — optional (requires your consent)
These cookies are only set if you click Accept all on the cookie banner. Choosing Essential only prevents all of the following from loading.
